Pre-launch notice. These plain-language terms describe the current Parking Bay product but are not final legal advice. The registered operator details and final launch terms must be reviewed by a New Zealand lawyer before public launch.
1. Parking Bay's role
Parking Bay provides a marketplace that helps Drivers find parking spaces offered by Hosts. Unless expressly stated otherwise, Parking Bay does not own, operate or control a Host's parking space.
2. Accounts and security
You must provide accurate and current information, keep your login confidential and promptly report suspected unauthorised access. You must not impersonate another person or create an account without their authority.
3. Host responsibilities
Hosts must have authority to list the space, provide accurate details, keep access reasonably safe and available for confirmed bookings, respect neighbours and local rules, and provide lawful arrival instructions.
4. Driver responsibilities
Drivers must use only the confirmed space and time, provide accurate vehicle details, follow lawful arrival instructions, avoid damage or obstruction, and leave the space promptly.
5. Prices and payments
Before payment, Drivers are shown the parking price, Driver service fee and total. Payments, payouts and refunds are processed by Stripe. Parking Bay does not store full card numbers. Bookings and payments must remain on Parking Bay.
6. Cancellations and refunds
Applicable cancellation and refund rules will be shown before payment. If a Host cannot provide a confirmed space, the Driver should receive an appropriate refund. Nothing in these terms limits remedies required under New Zealand law.
7. Insurance and risk
Hosts should check that their property arrangements and insurance permit paid parking activity. Drivers are responsible for lawful vehicle use and appropriate vehicle insurance. Parking Bay does not currently verify insurance cover.
8. Prohibited conduct
Users must not publish fraudulent or unlawful listings, bypass payments, harass or discriminate against others, misuse private addresses or arrival instructions, upload harmful or offensive content, or use Parking Bay for illegal activity.
9. Content and intellectual property
Parking Bay owns or licenses its software, branding, interface and original content. Users keep ownership of content they submit but grant Parking Bay permission to host, display and process it as reasonably required to operate the marketplace.
10. Service availability and disputes
The service may be affected by outages, severe weather, government action, third-party services or events outside reasonable control. Users should communicate respectfully and preserve relevant evidence when a problem occurs.
11. Privacy
Use of Parking Bay is also governed by the Privacy Policy, including how exact addresses, arrival instructions, payments, verification information and early-access registrations are handled.
12. New Zealand rights
Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including rights that may apply under New Zealand consumer, privacy and fair-trading law.
